'Tamanchey' in trouble for copyrights violation?

Shemaroo to send a legal notice alleging that the makers 'Tamanchey' don’t have copyrights for the song lifted from 'Mahaan'

The official trailer of 'Tamanchey' features the song, Pyaar mein dil pe maar de goli, which is originally from Amitabh Bachchan's film, Mahaan. Sources say that the makers of Tamanchey don't have the song's copyrights to have used it in the first place.

"We were surprised to see Mahaan's song being played in the background in Tamanchey's trailer. We are the IPR holders of the song and the makers of Tamanchey have not taken any permission from us. We will soon send a notice to them about the same," says Ketan Maru of Shemaroo.

Incidentally, the film's tagline, Pyaar mein dil pe maar de goli, is a line from the song. Maru says that he doesn't have a problem with that. "But using the song is a violation as no permission has been sought from us so far," he says.

However, actor Nikhil Dwivedi refutes the charges. He says, "We have taken the audio rights of the song from the music company and we are not using video footage from the film, so there is no violation. There have been several cases like this in the past; for instance, Tayyab Ali pyar ka dushman is a song from Amar Akbar Anthony that was used in Once Upon A Time in Mumbai Dobaara and Apni toh aise taise from Laawaris was played in Housefull."

But Maru refuses to buy the argument. "The makers of Tamanchey have created a new IPR by getting their hands on the audio rights of the song, This has affected our IPR and we object to that," he says.
