The Mumbai Police on Thursday registered a first information report (FIR) against Bollywood actor Mithun Chakraborty's wife Yogita Bali and son Mahaakshay on charges of rape, cheating, and causing miscarriage. The Oshiwara police registered after the police received a written application from a Bollywood actor, who claimed that Mahaakshay had sexually assaulted her from 2015 to 2018 on fake promises of marriage.

Police officials said that the complainant, who has worked in Hindi and Bhojpuri films stated that she was in a relationship with Mahaakshay since 2015. According to a report in Hindustan Times, the woman alleged that in 2015, Mahaakshay had called her to his flat for a meeting where she was offered a soft drink. She further claimed that she was not in her senses after having the drink and Mahaakshay allegedly sexually assaulted her.
In her written complaint to the police, the woman stated that Mahaakshay sexually assaulted her for four years and cheated her on the pretext of marrying her. She claimed that he had "fraudulently caused physical, emotional and mental loss to her".

Furthermore, the woman claimed that she got pregnant during their relationship, however, Mahaakshay asked her to get an abortion and also gave her medicine for the same. The actor said that Mahakshay's mother Yogita Bali was aware of the situation and has therefore been named in the complaint. Dayanand Bangar, senior inspector of Oshiwara police station said, "We have registered the offence and are investigating the case."

A first information report (FIR) was registered against Bali and Mahaakshay under sections 376 (2)(N) (commits rape repeatedly on the same woman), 328 (causing hurt by means of poison, etc, with intent to commit an offence), 417 (punishment for cheating), 506 (punishment for criminal intimidation), 313 (causing miscarriage without woman's consent) and 34 (common intention) of the Indian Penal Code (IPC).
The Oshiwara police registered an FIR after a Delhi court, which the actor had approached in 2018 had directed Delhi Police to register a case. However, the court later decided that the case should be investigated by the authority where the incident had occurred.
