The convict (29) is a rickshaw driver and used to drink and consume drugs with his earnings. He never contributed towards household expenses. He is married and has three children, the oldest of whom is 12 years old. But his wife had left him two years ago, fed up of his habits and his beatings.
The survivor (50) used to stay at Lallubhai compound, Mankhurd, with her husband, the convict, who is her older son, his three children, and her younger son, who is also married. The second son's pregnant wife was at her mother's place at that time.
On the night of August 5, 2013, the survivor was sleeping in the hall at 11.30 pm with her grandchildren, while her husband and other son slept in the kitchen. At 4 am the next day, the woman felt someone touch her and woke up to see that it was her elder son.
The 29-year-old put one hand on his mother's mouth and, threatening her with a knife, raped her. He even warned her against shouting, saying, "If you shout, I will kill you".
After raping her, when the convict went to the toilet, the survivor narrated the incident to her husband. Both of them filed a complaint at the Mankhurd police station, and the man was arrested the same day.
