Age cannot be a criteria to shortlist govt job seekers, rules High Court

The competency of a candidate for a particular job can only be decided on the basis of his/her educational qualification, experience or marks obtained in an examination or interview and not by the age.

"Wisdom may be an attribute of age, but not merit or competence. Unfortunately, age has nothing to do either with merit or competence," a Delhi High Court bench comprising Justices Madan B Lokur and AK Pathak held.

The judgement came on a petition against the decision by the Municipal Corporation of Delhi (MCD) to shortlist the applicants for teaching jobs in the OBC category.

The court rejected the MCD decision as "unconstitutional and violative of fundamental rights of others who were not shortlisted".
