Paving the way for the collection of voice samples of Shiv Sena MLC Neelam Gorhe and Milind Narvekar, personal assistant to Shiv Sena executive president Uddhav Thackeray, Judicial Magistrate (First Class) R L Wankhade yesterday rejected their plea seeking a stay order on the voice test.
The police wanted the samples to confirm a phone conversation they tapped was between Gorhe and Narvekar, accused of plotting violence during the protest against the Dadoji Konddeo statue removal from the Lal Mahal.
The court also rejected police plea seeking cancellation of Gorhe's and Narvekar's bail. The judge in his order said: "This court can not compel the accused to give their voice samples, therefore prayer of the prosecution can not be considered. Grounds mentioned in the application are also not sufficient to cancel the bail of accused. In the February 23 order it is already stated that if the accused did not give their voice samples, then only adverse inference can be drawn."
On Gorhe's and Narvekar's plea seeking 15 days' stay, the judge ordered that his court had no inherent powers to stay its own order.
