The first impeachment proceedings against a judge was taken up in the Rajya Sabha today, which converted into a court to take up a motion against Justice Soumitra Sen of the Calcutta High Court.

Communist Party of India-Marxist (CPI-M) leader Sitaram Yechury moved motions against Justice Sen.

The first of the two grounds of misconduct against 53-year old Justice Sen being cited in the motion is misappropriation of large sums of money, which he received in his capacity as receiver appointed by the High Court.

The second ground of misconduct is that he misrepresented facts with regard to the misappropriation of money before the High Court.

Justice Sen is the second judge against whom impeachment proceedings has been initiated.

The first such case was of V. Ramaswami, former Chief Justice of the Punjab and Haryana High Court, who later became Supreme Court judge. The motion for his removal came up in the Lok Sabha, but the House just chose to admonish him and did not pursue the matter further.

The resolution for impeaching Justice Sen was signed and moved in 2009 by 58 members of the Rajya Sabha after which Vice President and Rajya Sabha chairman Hamid Ansari constituted a three-member inquiry committee to probe the charges.
