Bandra Metropolitan Magistrate court, last month, had directed the police to register an FIR against Roy and others for illegally arresting one Raj Awasthi under Maharashtra Prevention of Dangerous Activities Act (MPDA) in January 2006.
The arrest was, allegedly, based on a fabricated complaint.
Roy gave sanction for Awasthi's arrest based on this complaint, but it was later found that there was no record of the complaint at the police station.
Government has filed petition in the High Court, challenging the magistrate's order.
Today, government sought more time for placing some additional material before the court, so the hearing was deferred till January 13.
