HC rejects petition filed by Adnan's wife

The Bombay High Court on Tuesday rejected the petition filed by Pakistani singer Adnan Sami's wife, who had sought direction from the court restraining him from entering her house.

The Bombay High Court on Tuesday rejected the petition filed by Pakistani singer Adnan Sami's wife, who had sought direction from the court restraining him from entering her house.



"The High Court has returned the petition and it will now have to be filed in the family court," said advocate Vibhav Krishna, Sami's lawyer said.



Saba had approached High Court, seeking a directive to keep Adnan away from her five flats in suburban Andheri, which he allegedly gifted her when they got married. Since the marriage is on the rocks - according to Saba's petition - she does not want Adnan to live with her.



Justice AV Nirgude had earlier asked Saba's lawyer, why she did not move the family court, as dispute between husband and wife, though related to property, would generally be heard by a family court. But senior advocate SU Kamdar, representing Saba, said that family court had refused to entertain her petition, since both of them are not Indian citizens.


While Saba is a citizen of United Arab Emirates, Adnan is a citizen of Pakistan. Adnan and Saba got married in April 2007 in Mumbai, in Muslim tradition. Saba has also filed a divorce petition in the High Court.
