Hema Upadhyay murder: Chintan Upadhyay files discharge application

Artist Chintan Upadhyay, held for the alleged murder of his ex-wife Hema and her lawyer Harish Bhambhani, yesterday filed a discharge application before the Dindoshi Sessions court.


The application was moved by Chintan's lawyers Raja Thakare and Bharat Manghani. It stated that the allegation that matrimonial dispute was the motive for the murder doesn't hold water because the dispute started in 2010, which was nowhere near the time when the alleged offence took place (December 2015). It added that the decree of divorce was given in Chintan's favour by the trial court.


Also, there were no financial constraints for Chintan, as he had already paid more than R18 lakh to Hema, the application stated, arguing against CBI's allegation of monetary dispute as also being a reason. "There is not even an iota of evidence to show that during the span of Chintan's eight-day stay in the house in Mumbai, there were any quarrels between them or any aggressive behaviour from him."

The application stated that according to the statement of Harish's wife Poonam, it was submitted that a so-called sketch with the words 'I will destroy you' written on them was made by Chintan a few days before the murder, but that has not even been recovered during the course of the investigation.

During the previous hearing, the prosecutor had argued on the point of charge framing against all the accused.
