However, the defence argued that the ATS could not apply the Maharashtra Control of Organised Crime Act (MCOCA) in the case as except one accused, Ashok Dhawde, no one else had any previous case against him or her, which is a requirement under the said Act. Dhawde is accused in Nanded and Parbhani blasts.
