A 11-year-old Mumbai girl, who was constantly raped by a distant relative 'to drive away evil spirits' testified against the perpetrator which landed him a life imprisonment.
The girl's family is based in Mysore. They had sent her to stay with the convict, Fazal Dafedar, in Mumbai in September 2014.
In her testimony, the girl said that the incident occurred on October 2014 when all members of the Dafedar family left for Gujarat for a week while she was asked to stay back with Dafedar. The child alleged that 'chachu' Dafedar raped her over three days, confined her to a room and threatened to kill her if she told the family about it. She only managed to tell the neighbours after three days. The neighbour then took her to the police station the next day and then she was sent for medical examination.
According to a report in Hindustan Times, the prosecution alleged that but the doctor did not examine her hymen and the medical report stated that there were 'no signs of force used and suggestive of vaginal and anal intercourse'.
The court, however, held the accused guilty on the basis of the testimony of the girl and other evidence. “The prosecution has sufficiently established the factual foundation that the girl was residing in the home under the shelter of the accused, who was her guardian, and he himself committed penetrative sexual assault and rape," a report in Hindustan Times said.
The girl was moved to an orphanage after the incident as her parents have not turned up to help her and she has refused to go to her house as she wants to concentrate on her studies.
The court has now asked the Dafedar to pay compensation of Rs 50,000 which would be paid to the girl when she turns 18.
