Habiba Ishaque Khan says it is her son Ashraf's (38) love of the good life that is to blame for his squandering paternal property running into crores over the last eight years.

On December 16 , the 61-year-old moved the sessions court to institute criminal proceeding against Ashraf under various sections of the Indian Penal Code, alleging that he has been torturing her since 2001.

Earlier, Ashraf allegedly forged property documents of a section of the family bungalow Unus House in Andheri (E) worth Rs 3 crore owned by his mother and mortgaged it to the Central Bank of India's JB Nagar Branch in March 2003 for Rs 8.95 lakh.

Habiba learnt of the mortgage only six years later when the bank stuck a notice that announced the auctioning of the bungalow on orders of the Bank Recovery Tribunal, as Ashraf had not repaid the loan.



On September 14, the Debts Recovery Tribunal stayed the auctioning of Unus House after Habiba moved the court against the orders of the Bank Recovery Tribunal.

"My in-laws had transferred the bungalow to my name in 1998 in keeping with the wishes of my husband though I did not get the bungalow registered in my name.

In 2003, he had admitted in an affidavit that the property belonged to me, and a few months later he fooled the bank into believing that it was his.

He forged my signatures and took a loan against this house," said Habiba.

Forging and forcing

"Over the years he sold family property worth crores in Mira Road, Alibaug and other places by either forging my signature or forcing me to sign.

He kept taking money from me under one pretext or the other to fund his lavish lifestyle. I now depend on my married daughter in Saudi Arabia for my sustenance. My son's greed has made him blind.

I hope he reforms. I will forgive all that he has done if he repents. After all, he is my son," Habiba added.

Habiba's lawyer, Fazil Hussain Sheikh, said, "We requested the court to direct the MIDC police station to register a case against Ashraf for perpetuatig the fraud and torturing his mother."

Ashraf Ishaque Khan said, "My mother is lying. I have all the documents to prove that I own the Unus House.

My motheru00a0transferred the property u00a0rights to me and now she is raising doubts and calling me a liar.
