Son of accused seeks relief claiming his father, co-accused were produced in court 60 hours after arrest which amounts to ‘illegal detention’

Hearing a writ petition filed in connection with alleged ‘illegal detention’ by the Samata Nagar police, the Bombay High Court has asked the public prosecutor to produce clinching evidence.

Petitioner Sumeet Shukla, a 30-year-old Virar resident, has sought relief for his father Vijayraj Shukla and a co-accused Shailesh Tiwari who were arrested for road rage and alleged kidnapping of a businessman on September 23. Sumeet told mid-day that his father and others were produced before Borivali court more than 60 hours after they were taken into custody by the Samata Nagar police which amounts to illegal detention.
“We direct the learned PP to produce CCTV records from the evening of September 23 till today, to file an affidavit of the concerned investigating officer and produce handwritten station diary before this court on November 11 [Thursday],” reads the court order passed by a bench of justices SJ Kanthawala and Abhay Ahuja on November 10. A copy of the order was also sent to the Additional Commissioner of Police Pravinkumar Padval. However, one constable came with one diary and told the court on Thursday that the affidavit was not ready. The matter will be heard on Friday, November 12.
