In a major development, the Narcotics Control Bureau (NCB) has moved Bombay High Court seeking cancellation of bail granted to Sameer Khan. A special court had given bail to Khan on September 27, who is the son-in-law of Maharashtra cabinet minister Nawab Malik.


According to Bar and Bench, Khan, along with two other accused, Rahila Furniturewala and Karan Sejnani, were booked under Sections 8(c), 20(b)(C), 27A, 27, 28 and 29 of the Narcotic Drugs and Psychotropic Substances (NDPS) Act.


The NCB had levelled charges of procuring, selling, purchasing and transporting 194.6 kg of ganja and 6 CBD (cannabidiol) sprays against the accused. According to the NCB, Khan was responsible for selling and financing drugs.


After the filing of chargesheet, Khan moved for bail application Section 439 of the Code of Criminal Procedure and was given the bail by a special court under NDPS Act citing lack of evidence.

The application filed by NCB will be moved for an urgent hearing in the high court this week. On the other hand, Khan has also moved a plea for quashing the NDPS case against him and is yet to be taken up.
