MACT awards Rs 4.5 lakh compensation to boy injured in car accident

The Motor Accident Claims Tribunal in Maharashtra's Thane district has awarded a compensation of Rs 4.5 lakh to a boy who was injured in a car accident in 2018.


MACT member H M Bhosale directed the owner of the offending car Eknath Gajanan Patil and its insurer HDFC ERGO General Insurance Co. Ltd to jointly and severally pay the compensation along with an interest of 8 per cent per annum from the date of filing of the petition.


An order to this effect was passed on September 21, and a copy of the same was made available on Monday.


The tribunal also ordered the respondents to pay Rs 3,000 towards the cost of petition to the petitioner.

The petitioner's lawyer A S Jagdale informed the tribunal that Riyazull Islam Sahidul Islam was a Class 1 student at the time of the accident.

On July 28, 2018, the boy was standing on the road at Khalcholi-Khardi village in Diva, when a car which was being reversed, knocked him down.

The child sustained severe injuries and was rushed to Kalwa civic hospital and then to Sion Hospital in neighbouring Mumbai in a critical condition, the lawyer said.

The boy suffered abdominal injuries, due to which he is unable to consume sufficient quantity of food. He also suffered 35 per cent disability, it was stated.

The car owner and insurance company contested the claim on various grounds.
