The Kerala High Court on Friday held that the fixation of the minimum period of separation of one year under Section 10A of the Indian Divorce Act, 1869 is violative of the fundamental rights and struck it down.
The court also directed the Central Government to seriously consider having a uniform marriage code in India to promote the common welfare and good of spouses in matrimonial disputes.
