However, the other three accused in the case were produced in the Shivaji Nagar court.
Kadeer was assaulted on Friday night by four men, including Shaikh and was admitted to the ICU of Sassoon General Hospital for two days and was termed critical. But the police took a soft stand and slapped sections 326, 323, 504, 452, 427and 34 of the IPC, but not 307 (attempt to murder) on the accused. A source in the Pune police commissionerate said that near fatal attacks are normally treated as attempted murder.
"The police did not arrest him more than 19 hours after the event and allowed him to file for anticipatory bail, which was granted last evening," said Salim Memon, Kadeer's brother.
Salim told the police that Shaikh was "untraceable", despite the fact that he had pointed out to the police that he was in his house and should be detained. The police allegedly told Salim "we know what to do".
Meanwhile, police sub-inspector Shailesh Sankhe who is investigating the matter said that Sheikh was granted bail, "but we do not have an official copy of the bail."
