When the PIL filed by an advocate that night safari should not be allowed in the park came up, the court gave its permission subject to the concerns expressed by the petitioner that it should neither disturb wild life nor adversely impact forest conservation in the park.
A vacation bench, comprising Justice Manjula Chellur and Justice B S Patil, also granted liberty to the petitioner to visit the park and experience the safari whenever he wished to and in case he found violations of any of the said conditions, he could move court.
