Additional Director General of Police (Lokayukta) R K Dutta, who earlier said that he would treat this as any other case, has now said that the legal cell had asked him not to file an FIR. Asked whether the cell opined 'need not' or 'should not', Dutta confirmed that the cell said 'should not'.
Deliberating on the issue, he said, "The court has asked the Lokayukta police to investigate and submit a report, since the order was passed under section 202(1) of criminal procedure code and there was no question of registering an FIR."
However, the Lokayukta police would follow the regular procedure during the course of investigations like examine documents, collect evidence and question suspects and accused. However, it will not have power to detain anyone.

The Additional Director General of Police (Lokayukta)u00a0 has said that they will treat this as any other cases that comes before Lokayukta, which means that we will be filing FIR against the Chief minister within two days under section 154 of Criminal procedure code.
"We would also question, the accused (without mentioning names) as part of the investigations to give them a fair chance for their version," Dutta had said.
