The Telecom Disputes Settlement and Appellate Tribunal (TDSAT) Bench headed by Justice Arun Kumar observed that it would like to wait for the report of the committee appointed by the Department of Telecom (DoT) for reviewing spectrum allocation policy.
The committee is yet to submit its report. In September 2007, the DoT had formed the committee, comprising experts, to study TRAI's recommendations on reforms in the licensing regime, spectrum allocation and acquisitions policy.
"The report of the committee constituted by DoT for review of spectrum matters is stated to be expected very soon. That may have some bearing in the present case. Therefore this case is deferred," the tribunal said.
CDMA operators RCom and Tata Tele, which were allotted GSM spectrum by the DoT under the dual technology regime, had approached the TDSAT last year seeking directions to the DoT to take back what it calls excess spectrum held by rival GSM operators.
