Assistant Commissioner of Police Vitthal Harihar said that if inquiry revealed information about the tenants was not given to the Kothrud police station, action would be taken against the owner under section 188 of the Criminal Procedure Code. "We have asked the owner Shah, currently residing at Warje, whom she had given the flat on rent and on what basis. We haven't reached any conclusion yet, but inquiry is going on," Harihar said.

"Primary investigations have revealed that the five youths detained on Sunday morning had come to the flat to celebrate the birthday party of Kaustubh Deshpande on Saturday night. After the party, angry residents of the Himali society including one Advocate Pandey had called up media persons and the local police station to complain against the youngsters. We are awaiting the legal opinion in this case and thereafter we will decide about the possible action that can be taken."

Speaking to the media on Sunday, Saraswati Oza, a committee member of Himali society, had said that the flat owner Samata Shah was a close relative of a prominent social activist in the city. "She has been part of several such agreements in the past too but never turns up when the tenants create problems for society members," Oza had said.

The youths detained and later let off on Sunday were identified as Amrutasingh Roopsingh, Amey Gosavi, Kaustubh Deshpande, Alok Jadhav and Amruta Yadav. Himali society residents Advocate Sharan Bhalchandra Pandey and Parag Oza had filed a complaint against the five younsters who were reportedly in an inebriated condition. The Kothrud police had recorded their statements on Sunday.
