Civic body files application in court asking for rejection of private suit seeking restoration of statue in Lal Mahal

Can the civil court order the civic body to place the Dadoji Konddeo statue back at the Lal Mahal? That is the question that will have to be answered.

The Pune Municipal Corporation (PMC) and the state government yesterday filed an application under Section 7(11) of the Civil Procedure Code in the court of Joint Civil Judge A S Rajendekar, asking for the rejection of the private suit filed by noted historian Pandurang Balkawade and other individuals seeking the restoration of Dadoji Konddeo's statue after the PMC removed it from the Lal Mahal.

The PMC had on Thursday filed an application through senior lawyer Dr Sureshchandra Bhosale challenging the court's jurisdiction in the matter under Section 9 A of the Civil Procedure Code (Maharashtra state amendment). The court yesterday reserved its order till Thursday. The PMC was to yesterday file its say on the matter after the court had granted it three days extension for the pusrpose on Thursday.

Balkawade along with Samajik Samarasata Manch's Suresh Dattatray Nashikkar and member of Lal Mahal Utsav Samiti Chandrashekhar Shinde had filed a private suit in the court on December 27 seeking restoration of Dadoji statue in its original place.

Balkawade's counsel Advocate Girish Shinde and Advocate Devidas Shinde maintained that the court had power to hear the matter.
