Naxal ideologue refuses to undergo narco test, moves High Court

He had been an 'outlaw' his whole life and Kobad Ghandy is yet again challenging the rule book.


The Naxal ideologue has refused to undergo a narco analysis for which a local Delhi court has granted permission. Contending that no law can force him to give evidence against himself, Ghandy has approached the Delhi High Court.




The Naxal leader is suffering from cancer.

After the panel of doctors declared him fit, Chief Metropolitan Magistrate Kaveri Baweja allowed the plea of the police.

Ghandy, in his application before the High Court, has also contended that the narco-analysis test has no legal validity.

The Maoist think-tank has cited that various matters challenging the validity of the narco-analysis test is still pending with the Supreme Court of India.

Ghandy, a Politbureau member of the banned CPI Maoist, in his petition submitted that an accused could not be forced to give evidence against himself under the law. He also maintained that he had not given any consent to the test.

Ghandy, arrested from the national capital on September 20, submitted that the magistrate should have waited for the Supreme Court judgment.u00a0He has been booked under various provisions of Unlawful Activities (Prevention) Act.
