Chennai: The Madras High Court today ordered issue of notice to Tamil superstar Rajinikant on a plea by a financier seeking to initiate action against Kasthoori Raja, father of the actor's son-in-law.

The financier Mukund Botra contended that Kasthoori Raja had given a written assurance to him that if he fails to repay the money he borrowed, Rajanikant would repay it.

Justice Ravichandra Babu also ordered issue of notice to the counsel for Kasthoori Raja and posted the matter after two weeks.

Botra stated that Kasthoori Raja had borrowed Rs 40,00,000 in 2012 for the production of Hindi film "Main Hoon Rajinikanth".

Botra stated that when Kasthoori Raja sought another Rs 25,00,000, he had given a written assurance that his son Dhanush was married to daughter of Rajinikanth and if he fails to repay the amount Rajinikanth will pay it.

The cheques issued by Kasthoori Raja to him were dishonoured and returned by the bank stating the reason as insufficient funds, Botra submitted.

After coming to know about the legal proceedings initiated against Kasthoori Raja, the family of Rajanikant had stated that "many persons are misusing his name", Botra submitted.

He submitted that he made a complaint to the Commissioner of Police and "without inquiring the complaint, it was closed stating that the complaint was a civil one in nature".

Botra submitted that his criminal petition filed in the High Court was dismissed after police submitted that the complaint given by him was civil in nature. He had filed a Special Leave Petition in the Supreme
Court against the High Court order, which is pending.

Botra submitted he had given money to the financier believing that Rajanikanth would repay the money in he fails to pay it and prayed to the court to direct Rajinikanth, who disowned himself to initiate action against Kasthoori Raja, to repay the money.
