The author of the best-selling Shiva trilogy Amish Tripathi has won a Bombay High Court order against a man who was pirating his books on the web. The HC has granted an injunction, in a hearing on Monday, in favour of Tripathi.

The author, through his publishers had sued one Harikrushna Dhanani, who had allowed the free download of Tripathi’s books online. Speaking to MiD DAY, his publisher Gautam Padmanabhan on behalf of Westland Ltd. said, “We take copyright infringement very seriously.
We got an injunction against (Dhanani) last week from the High Court. Dhanani had uploaded them onto a website, freebookhome.com.” From here, members of the public could freely download his three novels, The Immortals of Meluha, The Secret of the Nagas and The Oath of the Vayuputras.
On March 6, Tripathi learnt that Dhanani had made the three books available online for download as eBooks, or digital books. He therefore approached the Bombay High Court asking for an injunction against Dhanani from allowing such a download.
Tripathi has also sued the website’s registrars. Justice SJ Kathawalla on March 8 noted that it was a “clear case of infringement” of Tripathi’s copyrighted works under the Copyright Act, 1957. “There is a strong prima facie case made out for injunctive protection being granted to the plaintiff. It is a fit case for grant of mandatory injunction as continued exploitation of the Plaintiff's works on the websites will cause irreparable harm and injury,” Kathawalla ordered.u00a0
