An apex court bench of Justice G.S. Singhvi and Justice H.L. Dattu said all the five would be released on furnishing a surety of Rs.5 lakh each to the satisfaction of the trial court.
Pronouncing the judgment, Justice Dattu said it is open to the Central Bureau of Investigation (CBI) to move the apex court for the modification of the order, if the bail is misused.
The five are among the 14 individuals accused in the case, led by former telecom minister A. Raja and his DMK party colleague and Rajya Sabha member Kanimozhi Karunanidhi.
Their trial is being held by a special CBI court, presided over by Judge O.P. Saini.
